Woman suing Disney after falling at resort

A woman has filed a lawsuit against Walt Disney World that claims she sustained injuries from falling on a “cracked/broken/uneven” walking surface at one of the company’s resorts.

The lawsuit was filed on Monday, July 24, by Morgan & Morgan Attorney Alicia M. Smith on behalf of her client, Dena Cline-Kornik.

According to the complaint, on May 9, 2023, Cline-Kornik was visiting Disney’s Old Key West Resort (1510 N Cove Road) for business. During her visit to the resort, Cline-Kornik allegedly tripped and fell after walking over a walking surface that was “cracked/broken/uneven.”

As a result of the fall, Cline-Kornik claims that she suffered bodily injury that resulted in paint and suffering, disability, “significant scarring,” and activation of a “latent condition.”

The complaint accuses Disney of negligence and asks for a trial by jury and damages in excess of $15,000.

The lawsuit joins similar filings against the theme park over the past few weeks.

Billy Williams filed a complaint earlier this month accusing the park of an injury he sustained when he was thrown to the ground while riding The Haunted Mansion Ride at Magic Kingdom.

Williams is also being represented by Orlando-based Morgan and Morgan, according to the complaint.

Formerly known as Disney’s Vacation Club when it opened in December 1991, the Old Key West Resort was renamed in 1996. The resort was the first of Disney’s timeshare options and has the largest rooms of any of the 15 vacation resorts that the company operates.
